1. Overview
Simply Smart Tutoring (“we,” “our,” or “us”) provides individualized online reading instruction for students in grades K–5. By enrolling in tutoring services, you (“client,” “parent,” or “guardian”) agree to the terms outlined below.
2. Services Provided
Tutoring sessions are conducted online and may last 30 or 60 minutes.
Sessions are booked manually and typically follow a recurring schedule.
Instruction is focused on reading development using research-based methods.
3. Payments
Payments are processed via Stripe on a recurring four (4) week basis.
Clients may cancel services at any time.
Sessions canceled with at least 24 hours’ notice will be rescheduled whenever possible. If a reschedule cannot be arranged, a credit or refund for the unused session may be provided on a case-by-case basis at the tutor’s discretion.
Sessions canceled with less than 24 hours’ notice will be charged as if completed.
4. Attendance and Cancellations
Tutor cancellations: If the tutor cancels, clients may choose between a full refund or a reschedule.
Make-up sessions: Allowed when at least 24 hours’ notice is given.
Student attendance: Students are expected to be on time, engaged, and focused on the skills being taught.
5. Technology Requirements
Clients are responsible for ensuring that the student has access to a reliable internet connection, a suitable device, and any required software or platform needed to participate in online tutoring sessions.
Simply Smart Tutoring is not responsible for disruptions caused by technical issues on the client’s side, including connectivity problems, device malfunctions, or user error.
If a technical issue occurs on the tutor’s side that significantly impacts the session, the session will be rescheduled at no additional cost.
6. Late Arrival
Students are expected to arrive on time for scheduled sessions. If a student arrives late, the session will still end at the originally scheduled time.
Missed time due to late arrival will not be extended or refunded.
7. Communication
Communication with parents occurs via text or email.
Parents are asked to inform the tutor of any known behavioral concerns or potential absences as early as possible.
If a student exhibits persistent disrespect or disruptive behavior, Simply Smart Tutoring reserves the right to end services. Refunds may be issued at the tutor’s discretion if it is determined that the timing or fit is not appropriate.
8. Termination of Services
Simply Smart Tutoring reserves the right to suspend or terminate services with written notice for reasons including, but not limited to, non-payment or repeated cancellations.
In most cases, reasonable notice and an explanation will be provided prior to termination. However, Simply Smart Tutoring reserves the right to terminate services immediately if circumstances warrant, including situations that significantly disrupt the learning environment or violate these Terms.
Clients may discontinue services at any time.
In the event that services are terminated, any unused prepaid sessions may be refunded on a case-by-case basis at the tutor’s discretion.
9. Recordings, Photos, and Testimonials
Sessions may be recorded for quality and training purposes. Parents provide written consent once for recordings at the time of enrollment.
Photos, videos, and testimonials will only be collected or used with specific parental permission at the time of creation.
Clients are prohibited from recording or redistributing sessions without written permission from Simply Smart Tutoring.
10. Privacy and Confidentiality
Student data, progress notes, and contact information are securely stored within FullScope Freelancer.
Information is used solely for educational purposes and will not be shared with outside parties without parental consent, except when required by law.
11. Educational Disclaimer
Simply Smart Tutoring provides general educational instruction and guidance.
Stacy Wiest does not provide medical, psychological, or diagnostic services. Parents seeking diagnostic evaluations should contact a licensed professional.
12. No Guarantee of Results
Simply Smart Tutoring provides individualized, research-based instruction designed to support student learning and growth. However, educational progress depends on many factors beyond the tutor’s control, including student engagement, practice outside of sessions, and individual learning differences.
As a result, Simply Smart Tutoring does not guarantee specific academic outcomes or results.
13. Limitation of Liability
Simply Smart Tutoring and its owner are not liable for:
Internet outages, power failures, or technical issues on the client’s side
Learning outcomes or academic progress
Injuries or damages resulting from at-home activities or use of provided materials
Decisions made by parents or guardians based on tutoring feedback or advice
Any events beyond the tutor’s reasonable control
If a technical issue occurs on the tutor’s end, the session will be rescheduled at no cost.
14. Intellectual Property
All materials provided (including PDFs, slides, and resources) are for personal use only and may not be shared, sold, or distributed.
Clients may not record, reproduce, or distribute sessions or materials without written consent.
15. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of South Dakota, without regard to its conflict of law rules.
16. Dispute Resolution
Disputes should first be addressed directly with Stacy via email or phone.
If the matter cannot be resolved, it may be handled through small claims court in Davison County, South Dakota.
Each party agrees to make a good-faith effort to resolve concerns before pursuing legal action.
17. Entire Agreement
These Terms and Conditions constitute the entire agreement between the client and Simply Smart Tutoring and supersede all prior or contemporaneous communications, whether written or verbal.
18. Third-Party Platforms
Simply Smart Tutoring may use third-party platforms, including FullScope Freelancer, to facilitate scheduling, communication, and record-keeping. While reasonable care is taken in selecting these tools, Simply Smart Tutoring is not responsible for technical issues, data breaches, or service interruptions originating from third-party providers.
19. Agreement
By enrolling in tutoring services or making a payment, you confirm that you have read, understood, and agree to these Terms and Conditions.
